Buyer/Seller and Dual Agency

When working with an agent, it is very important that you understand exactly who's interests that agent is contractually obligated to represent. In Washington State is required by law that an agent disclose who they are representing in the transaction.

The Listing Agent is the agent who is under contract to represent the interests of the Seller of the property. It is their duty and obligation to obtain the best/highest possible price for the Seller, and to disclose any known facts that would further this purpose to the Seller. When contacted by a Buyer, a listing agent would explain that they represent the Seller and present the required Law of Real Estate Agency Pamphlet at their first opportunity.

Buyers Agency is when the agent represents the interests of the Buyer. It is their duty and obligation to obtain the best/lowest possible price for their Buyer, and to disclose any known facts that would further this purpose to the Buyer. When contacted by a Buyer, a buyer's agent would explain that they represent the Buyer only and present the required Law of Real Estate Agency Pamphlet at their first opportunity.

Dual Agency: Typically this term is used when one agent represents both the Buyer and Seller in a single transaction. After reading the above explanations, it becomes clear why this can be very confusing for everyone involved. While this practice is illegal in some states, it is still acceptable in Washington State provided that the agent involved discloses to both parties that they will be acting as a dual agent.

At Lopez Village Properties, we feel that each party is best served when they are represented by their own, exclusive agent. Our goals and obligations are very clear and it eliminates the obvious conflict of interest concerns. Therefore our agents do not engage in Dual Agency which allows one person represents both the Buyer and the Seller in a single transaction.
